LumiTales — Terms of Service

Applicable regulatory framework: Spanish Law 7/1998, of 13 April, on Standard Contract Terms; Royal Legislative Decree 1/2007, of 16 November, approving the consolidated text of the General Law for the Defence of Consumers and Users; Directive 2011/83/EU of the European Parliament and of the Council, of 25 October 2011, on consumer rights; together with the applicable contractual obligations arising from the agreements with Apple App Store and Google Play.

Language and prevalence: The original, legally-prevailing version of these Terms is in Spanish — see /es/terms. This English version is provided as a courtesy translation. In the event of any discrepancy or conflict between language versions, the Spanish version shall prevail (§9.5).

2. Acceptance of these Terms

By creating an account, subscribing or otherwise using LumiTales, you accept these Terms of Service in full. If you do not agree with any of the points described below, you may not use the application.

These Terms constitute a binding contract between you (the account holder) and the provider identified in §1.


3. Eligibility and account model

3.1 Minimum age of the account holder and use model

3.2 Child profiles

LumiTales lets the adult create child profiles inside their account. These profiles do not constitute independent accounts. The adult holder is responsible for the use that their children make of the application through these profiles.

3.3 One account per person

Each person may have a single LumiTales account. Creating multiple accounts or transferring accounts to third parties is not allowed.

3.4 Positioning as an app directed to children

LumiTales is primarily directed to children (Children's app on Google Play, Designed for Families programme). Minors are the primary recipients and consumers of the content (illustrated stories, narration, audio); adults are the holders and purchasers of the service. Subscription contracting and acceptance of these Terms is performed exclusively by the adult holder, while the minor consumes content within the holder's account and under the holder's supervision.

3.5 Preliminary age screen ("age-neutral screen")

On first launch, the user must select on a preliminary screen whether they are an adult or a minor. This selection drives the subsequent flow:


4. Subscription and payments

4.1 Free trial

LumiTales offers a 7-day free trial with full access to all Premium features. The trial starts automatically upon registration.

4.2 Premium plans

After the trial, access to the application requires a Premium subscription. Current prices are shown by Apple App Store or Google Play at the time of subscription and may vary by region and local currency.

Available tiers at launch:

LumiTales reserves the right to modify future prices with reasonable prior notice to existing users.

4.3 Payment processing

All transactions are processed through Apple App Store or Google Play, depending on the platform from which the subscription was made. LumiTales does not receive or store payment-method information — that data is handled directly by the respective platform.

4.4 Auto-renewal

The subscription auto-renews at the end of each billing period (monthly or yearly) unless you cancel at least 24 hours before the end of the current period, in line with each platform's policies.

4.5 Cancellation

You may cancel your subscription at any time from the subscription settings of Apple App Store or Google Play. Cancellation is effective at the end of the paid billing period, during which you keep full access to Premium features. There is no penalty for cancelling and no refund for the unused portion.

4.6 Refunds

LumiTales subscriptions are charged through your Apple App Store or Google Play account. Refund requests must be addressed directly to the corresponding platform under its refund policy. LumiTales does not process refunds directly. As an EU consumer, you retain the withdrawal rights granted by applicable regulations.

4.7 Family Sharing

LumiTales supports Apple's Family Sharing and Google Play's Family Library. A Premium subscription can be shared with up to 5 members of your verified family group, under the conditions each platform sets.

Each family-group member keeps their own LumiTales account with their own data (child profiles, favorites, history). Premium status is automatically synced to every member while the subscription remains active.


5. Content and licences

5.1 Content ownership

LumiTales owns all intellectual-property rights over the stories, illustrations, sounds and other content generated and distributed through the application, including but not limited to the versions translated into any language. The artificial-intelligence service providers used internally to generate that content (OpenAI, Google, ElevenLabs) assign to LumiTales the rights over the generated outputs in accordance with their respective terms of service.

5.2 Licence granted to the user

By subscribing to LumiTales, we grant you a limited, personal, non-transferable, non-commercial and revocable licence to:

The names you assign to child profiles, the ratings you leave and the preferences you configure inside the application are content provided by you. LumiTales processes it solely to deliver the service as described in the Privacy Policy. We do not claim ownership over this personal data.

5.5 Child Safety Standards — CSAE prohibition

LumiTales adopts a zero-tolerance stance against Child Sexual Abuse and Exploitation material (CSAE):

This clause is published in fulfilment of the requirements of Google Play's "Child safety" Developer Program Policy article and of the Child Safety Standards Policy.

6. Acceptable use

6.1 Account security

You are responsible for keeping the confidentiality of the Google account associated with LumiTales and for any activity carried out from it. Notify lumitales.oficial@gmail.com immediately if you suspect unauthorised access to your account.

6.2 One account per person, multiple devices OK

Each person may keep only one LumiTales account. The account is personal and non-transferable — you may not sell it, lend it, share credentials with third parties (except through Apple's official Family Sharing or Google Play Family) or assign it in any way. You may use your account on multiple personal devices (phone, tablet) without technical limits.

6.3 Compliance with the law

You undertake to use LumiTales in compliance with applicable law, without using the service for unlawful, fraudulent or public-order-contrary purposes.

6.4 User conduct and contributed content

When creating child profiles or contributing content to the service (profile names, ratings, comments, etc.), you undertake NOT to include:

6.5 Service access

LumiTales commits to keep the service available with the highest stability possible, but does not guarantee uninterrupted availability. Outages may occur due to scheduled maintenance, technical failures, third-party-provider actions (Apple, Google, OpenAI, ElevenLabs, etc.) or force-majeure events. If a significant outage affects service usage for an extended period, LumiTales will evaluate reasonable compensation case by case (for example, a subscription-period extension). Minor individual incidents will not trigger compensation.

6.7 Attention and safety

LumiTales must not be used in circumstances that demand the user's full attention (driving vehicles, operating machinery, supervising other safety-critical activities, etc.). You are responsible for ensuring that both you and the minors that use the application under your account do so in safe and appropriate conditions.

6.8 VPNs and geographic restrictions

The use of VPNs, proxies or other location-masking tools to evade price restrictions, regional availability, country-specific content or other policies tied to the user's region is not allowed. Subscriptions are governed by the conditions applicable to the country where the purchase was made.

6.9 Parental supervision

LumiTales is an entertainment and reading-support tool. It does not replace the supervision, judgement or responsibility of parents, mothers or legal guardians over minors in their care. As the account holder, you are responsible for the use that minors make of the application through the profiles you create, including exposure time and content suitability for each age.

6.10 Nature of AI-generated content

LumiTales' content is generated by artificial-intelligence systems on the back of automated quality reviews. While we apply multiple validation layers to ensure that the content is appropriate for children, we do not guarantee that every story, illustration or sound will satisfy specific tastes, preferences or editorial standards of the user. The daily theme varies and bespoke content cannot be requested. If you find content you consider inappropriate, please report it to lumitales.oficial@gmail.com so we can review and improve it.

6.11 Not a substitute for professional guidance

LumiTales is an entertainment and recreational reading-support application. It does not constitute therapy, professional educational counselling, pedagogical assessment or intervention for the special needs of the minor. Use of the application does not guarantee specific outcomes in the child's cognitive, linguistic or emotional development. For specific needs (reading difficulties, dyslexia, attention, etc.) consult a qualified professional.

7. Suspension and termination

You may terminate your relationship with LumiTales at any time in the following ways:

LumiTales may suspend or terminate your account immediately and without prior notice when it detects any of the following:

LumiTales will apply the measure it considers proportionate to the detected event (temporary suspension, indefinite suspension or final termination) at its sole discretion.

7.3 No formal appeal process

LumiTales does not offer a formal appeal process against suspension or termination decisions. The user may, however, contact lumitales.oficial@gmail.com to provide information or evidence they consider relevant; LumiTales will assess that information at its sole discretion and without commitment to predetermined response times.

The user's right to file a complaint before the Spanish Data Protection Agency (AEPD) or any other competent authority remains intact in any case.

7.4 Service shutdown

Should LumiTales decide to permanently discontinue the service, we will notify users at least 30 days in advance through the application and, where possible, by email to the address associated with the account.

During that notice period:

Once the notice period has elapsed, all personal data will be erased or anonymised as described in the Privacy Policy (§7). The application will stop working and it will not be possible to recover stories, favorites, history or any other data.

8. Limitation of liability

8.1 Service provided "as is"

LumiTales is provided "as is" and "as available", without express or implied warranties beyond those required by Spanish and European consumer law. While we make our best efforts to keep the service functional, secure and high-quality, we cannot guarantee that it is free from errors, interruptions, viruses or that it will meet each user's particular expectations.

8.2 Exclusion of indirect damages

To the maximum extent permitted by applicable law, LumiTales will not be liable for indirect, incidental, consequential, special or punitive damages arising from the use or inability to use the application, including but not limited to:

8.3 Quantitative liability cap

In any case in which LumiTales is held liable for damages, the aggregate financial liability shall be limited to the greater of the following amounts: (i) the amount actually paid by the User for the subscription during the twelve (12) months immediately prior to the event giving rise to the damage, or (ii) fifty euros (EUR 50). This limitation shall not apply in cases of wilful misconduct, gross negligence, personal injury, death, or any other circumstances in which mandatory Spanish law does not permit the limitation or exclusion of liability.

8.4 Reliance on third-party providers

LumiTales relies on services provided by third parties (Apple, Google, OpenAI, ElevenLabs, RevenueCat, among others) whose availability and operation are outside LumiTales' direct control. We are not responsible for failures, outages, policy changes, unavailability or any other problem originating in those external providers. If a third-party provider modifies its conditions, suspends its services or disappears, LumiTales will make its best efforts to replace it or adapt the service, but assumes no liability for the disruptions this may cause.

8.5 Force majeure

LumiTales will not be liable for the breach of its obligations when caused by force-majeure or fortuitous events, including but not limited to: natural catastrophes, armed conflicts, terrorist attacks, pandemics, governmental decisions, widespread telecommunications or energy failures, cyberattacks on critical infrastructure, decisions by cloud providers or any other cause reasonably outside our control.

8.6 User indemnification

You undertake to hold LumiTales harmless against any claim, demand, damage or expense (including reasonable legal costs) that may arise from:

The above limitations and exclusions of liability do not affect the mandatory rights that consumer law grants you as a consumer in the European Union, including the right to receive a service that conforms to what was contracted and the remedies provided by that legislation.

9. Governing law, jurisdiction and final provisions

9.1 Governing law

These Terms of Service are governed by the laws of Spain, without prejudice to the mandatory rights that European consumer law grants you as a consumer in your country of residence.

9.2 Jurisdiction for EU consumers

If you act as a consumer with habitual residence in an EU Member State, you may file claims either before the courts of your domicile or before the Spanish courts, at your choice.

9.3 Jurisdiction for non-EU users or non-consumers

For users not acting as consumers, or who reside outside the European Union, the parties expressly submit to the courts of Madrid, Spain, waiving any other forum that may apply to them.

9.5 Language of these Terms

These Terms are originally drafted in Spanish. Where translations to other languages exist (English or others), the Spanish version prevails in case of discrepancy or conflict between versions.

9.6 Severability of clauses

If any clause of these Terms is declared null, unlawful or unenforceable by a competent authority, that declaration will not affect the validity of the remaining clauses, which will remain in force to the maximum extent permitted by law.

9.7 Entire agreement

These Terms of Service, together with the Privacy Policy, constitute the entire agreement between you and LumiTales in relation to the use of the service, superseding any prior communication, agreement or understanding, oral or written.

9.8 Modifications to these Terms

LumiTales may modify these Terms at any time. Material changes will be notified through a prominent in-app notice on the next start, requiring your re-acceptance to keep using the service. Minor changes (wording fixes, clarity improvements) will be published silently. The current version of these Terms will always be available from Settings → "Terms of Service" and at the official public URL.


10. Apple App Store specific provisions

The following clauses are included as required by Apple Inc. for applications distributed through the App Store:

10.1 No contractual relationship with Apple

Apple Inc. is not a party to these Terms of Service. These Terms constitute an agreement exclusively between you and LumiTales, not between you and Apple. LumiTales is solely responsible for the application and its content.

10.2 Technical support

Apple has no obligation to provide maintenance or support services for LumiTales. Any support inquiries, failures or claims related to the application should be directed to lumitales.oficial@gmail.com.

10.3 Warranty

If the application fails to comply with any applicable warranty, you may notify Apple, and Apple will refund the purchase price of the application if appropriate under its policies. To the maximum extent permitted by applicable law, Apple will have no other warranty obligation in respect of the application.

10.4 Claims

LumiTales (not Apple) is responsible for any claim by you or by third parties related to the application or to your possession and use of it, including (without limitation):

10.5 Third-party intellectual property

If a third party alleges that the application or your possession and use of it infringes that third party's intellectual-property rights, LumiTales (not Apple) will be responsible for the investigation, defence, settlement and discharge of any infringement claim.

10.6 Compliance with export laws

You declare that (a) you are not located in a country subject to a US-government embargo or that has been designated by the US government as a country supporting terrorism, and (b) you are not on any US-government list of restricted or prohibited parties.

10.7 Apple as third-party beneficiary

You acknowledge and agree that Apple and its subsidiaries are third-party beneficiaries of these Terms, and that, upon your acceptance, Apple will have the right (and will be deemed to have accepted the right) to enforce these Terms against you as a third-party beneficiary.
